Please read these terms and conditions before you make a Going For Gold reward choice . Making a reward choice and placing an order on www.peoplevalue.co.uk/goingforgold constitutes acceptance of them.
The Going For Gold Rewards service is operated on behalf of Whitbread Plc (“WHR”) by People Value Limited, Company Number No 4516741, whose registered office is at Victor House, Wheatley Business Centre, Old London Road, Wheatley, Oxford, OX33 1XW.
The terms and conditions set out here apply to your personal rewards which you have received by WHR.
Going for Gold Rewards are awarded to You by WHR and will expire once WHR ceases to have arrangements in place with PV or upon termination of your employment with WHR which would be notified to You.
Rewards can only be held and redeemed as set out in these terms. Any other use, or attempt to do so, is a serious breach of these terms. Any use not in accordance with these terms will be invalid. You can only redeem Rewards in your own name and Rewards have no cash value.
If You think an unauthorised person has become aware of your unique reference number, please notify PV immediately using the contact information at the end of these terms and conditions. Neither PV nor Your employer can be responsible for any unauthorised use of your rewards.
WHR may, following notification to You, request PV to immediately suspend or terminate Your participation in the Rewards scheme, and/or stop any relevant reward, if there is a breach of these terms by You, if You are abusive or offensive to any member of PV’s staff, if Your employer or PV reasonably believe that You have dealt with Rewards in a manner not permitted by these terms, or suspect fraud or misconduct in relation to any reward, in which case also, the issue of Rewards may be refused or cancelled.
Use of any information transmitted under it are intended solely for the use of the Scheme member for whom it was created. If information is received in error please notify PV immediately using the contact information at the end of these terms and conditions. The information must not be used for any purpose.
You undertake to co-operate fully with PV and Your employer in any investigation that either or both may wish to carry out in relation to Your Reward or Your use of the Rewards Catalogue.
YOU MAY ONLY PURCHASE ITEMS AS PART OF GOING FOR GOLD REWARDS IF YOU ARE 18 OR OVER AND CAN FORM LEGALLY BINDING CONTRACTS UNDER ENGLISH LAW. YOU MAY NOT PURCHASE ITEMS IF YOUR MEMBERSHIP OF GOING FOR GOLD REWARDS HAS BEEN SUSPENDED OR WITHDRAWN BY WHR, YOUR EMPLOYER OR PV. THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
Where a voucher carrying a specified cash value or benefit is chosen, the voucher will have an expiry date specified on it and will be subject to any other terms and conditions stated on the voucher or otherwise publicised.
Only original vouchers will be accepted. Damaged, defaced or photocopied vouchers will not be accepted. Once your reward has been redeemed for vouchers, they cannot be exchanged. Once any vouchers has been used for a reward, they will not be returned if you cancel.
When You select your Reward it will be supplied by PV your contract will be with PV under the following terms and conditions. PV will process and confirm orders for such merchandise on behalf of Your employer.
Each order for goods or services received by PV is an offer by You to purchase such goods or services subject to these terms and conditions, together with the manufacturer’s or the service provider’s terms and conditions.
Some rewards may be subject to terms and conditions which preclude You from taking up, or impose restrictions on Your chosen reward. Please check with the service provider or us for any such restrictions before ordering.
Many of the goods and services available through the WHR Rewards catalogue are of a technical nature and it is not practical to publish detailed specifications of all the goods. All images, descriptive matter, specifications and advertising in the catalogue and on the Website are for the sole purpose of giving an approximate description of the goods and services. Full detailed specifications are available from the manufacturer’s or service provider’s brochures, the manufacturers or service providers direct and/or their websites.
All reward specifications, images and other information published in the catalogue and on the Website have either been made accessible by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. Our intention is to ensure that all information in the catalogue and on the Website is as accurate and up to date as possible. However, PV cannot guarantee the reliability or the accuracy of the information contained within the catalogue and Website. Should an inaccuracy be discovered following receipt of your order, you will be informed and you may decide whether to cancel or confirm the order.
All goods and services are subject to availability and may also be withdrawn at any time after You place an order. If we do not supply any goods or services for any reason, we will not charge You for it. If an item is out of stock, or no longer available, You will be contacted and asked if You would to like to cancel the order or accept the revised estimated delivery date (back order). Any such date will be an estimate only and will depend on the availability of the relevant product.
All reward items are inclusive of delivery to the site of your employment.
We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control.
You shall comply with all applicable domestic and international laws, statutes and regulations regarding Your use of the Website and our services.
Except as explicitly stated otherwise, any notices shall be given by postal mail to PV Attn: CEO/Legal Department, People Value Limited, Victor House, Wheatley Business Centre, Old London Road, Wheatley, Oxford, OX33 1XW or email to csdept@peoplevalue.co.uk. Notice shall be deemed given 24 hours after email is sent and confirmation received, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by email or certified mail, postage prepaid and return receipt requested, to the address provided to PV. In such case, notice shall be deemed given 3 days after the date of mailing.
Without limiting other remedies, we may limit your activity, issue a warning, temporarily suspend, indefinitely suspend or terminate your redemption of rewards through us and refuse to provide our services to you if: (a) you breach these terms and conditions or the documents they incorporate by reference; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for anyone including you, our customers, users or us.
Subject to any claim relating to personal injury, death or fraud PV, including its subsidiaries, officers, directors, employees expressly excludes its liability for: (a) loss of indirect profits; (b) loss of business; (c) loss of revenue; (d) loss of management time; (e) loss of goodwill; (f) loss of reputation; (g) wasted expenses; (h) anticipated savings; (i) any increased costs or expenses; and/or (j) indirect or consequential loss or damage of any nature whatsoever.
Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
In the event a dispute arises between you and PV, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, we strongly encourage you to first contact us directly to seek a resolution.
